Terms and conditions make it clear to us and our clients what should happen in any particular circumstance. They outline the important commercial terms and make it easier to grasp the obligations, privileges, and roles played by both parties.
Here are the details of JK WebApp website project terms. When we collaborate, they are designed to support both parties. Sometimes a longer contract may be negotiated, but this page provides a general understanding of the agreements we have. The terms mainly apply to web design projects, although they also cover domain names and online hosting.
Specification Agreement: Before starting any project-related work, a detailed specification will be mutually agreed upon. This includes the provision of all necessary website content and a clear agreement on required functionality.
Estimates vs. Final Pricing: Any estimate provided prior to finalizing the complete specification is only a preliminary work estimate. Once the full specification is confirmed, the final project pricing may be adjusted accordingly.
Project Confirmation: After the specification is approved, the client will receive the final price along with an approximate project start date and completion timeline, subject to timely payment of the required deposit.
Deposit Requirement: A 60% deposit is required once project pricing has been agreed upon. Work will only commence after the deposit has been paid in full and cleared in JK WebApp’s bank account.
Final Payment: The remaining 40% balance is due within 7 working days of JK WebApp’s involvement in the project being completed, as stated on the invoice. This payment is required regardless of the involvement of other parties.
Interim Payments: For projects extending beyond one month, interim payments may be requested based on the progress of completed work. These interim payments will be deducted from the final 40% balance.
Refunds: Deposits are non-refundable once work has commenced. Deposits for smaller projects are at JK WebApp’s discretion and may vary. Deposits will only be refunded if no work has begun.
Project Termination: If, at any point, the client decides to discontinue the project or is dissatisfied with the direction of the work, the client agrees to pay JK WebApp in full for the time and work completed up to that stage.
Website Health Check: Full payment is required in advance before JK WebApp commences any Website Health Check services. An invoice will be issued, and no refunds are available for this service.
Browser Support: Websites are tested on the latest versions of major browsers including Microsoft Edge, Opera, Mozilla Firefox, Safari, and Google Chrome. If support for additional browsers or older versions is required, this must be specified at the beginning of the project and will be included in the initial quotation and cost.
Platform Testing: All websites are tested on both Windows and macOS platforms to ensure compatibility and functionality.
Mobile & Responsive Design: If a project requires a mobile-friendly (responsive) design, testing will be carried out on Android smartphones and tablets, as well as on Apple iOS devices.
Additional Testing: Any further testing beyond the above can be arranged upon request; however, this will incur additional costs.
Completion Timeline: JK WebApp will make every effort to complete projects within the agreed timeline. In the event of unforeseen circumstances, clients will be notified promptly if the project cannot be completed by the predetermined deadline.
Requests for Modifications: All requests for additional work or changes to the project specification must be submitted in writing (e.g., via email).
Impact on Price & Timeline: Any changes or additional work requested after the specification has been agreed upon or after work has commenced may affect both the project timeline and final cost. Such requests will be quoted separately, and upon approval, billed in advance as interim payments.
Rush Work: If a client requests a revised deadline earlier than originally agreed, a rush fee will apply. This will be discussed and confirmed before any rush work begins.
Client Review Responsibility: While JK WebApp performs thorough testing and quality checks, the client is ultimately responsible for reviewing the completed project and ensuring it meets their requirements.
Payment Terms: Web hosting fees are payable annually in advance or on a monthly recurring basis.
Cancellations: Hosting cancellations must be requested in writing via email. Cancellations do not qualify for refunds of any kind.
Non-Payment & Account Termination: If hosting payment is not received within 7 days of the invoice due date, the hosting account will be suspended or terminated. This means the website will no longer be accessible to users. Accounts may be reinstated once all outstanding payments are cleared in full.
Hosting Provider Terms: All hosting services are also subject to the Terms of Use set by the chosen Web Hosting Provider, in addition to JK WebApp’s policies.
Domain Ownership: All domain names purchased through JK WebApp are registered on the client’s behalf. The client is the legal owner of the domain name.
SSL Certificates: SSL certificates can be arranged upon request. These are also purchased and set up on the client’s behalf.
Provider Terms: Domains and SSL certificates are subject to the Terms of Use of the respective Domain Provider or Hosting Provider, in addition to JK WebApp’s policies.
Web Design Projects: Payment for completed web design projects is due within 7 days of the invoice date.
Other Services: For smaller web development tasks or additional services, payment is due within 14 days of the invoice date.
Website Health Check: Full payment must be made in advance before any Website Health Check service begins. No refunds are available for this service.
Tax Compliance: JK WebApp is VAT/GST registered. All invoices will include the applicable tax in compliance with government regulations.
Agreement to the above Terms & Conditions is deemed to have been made once the client pays the initial 60% deposit. This payment confirms acceptance of JK WebApp’s policies and the commencement of the project under these terms.
Many websites require assistance with site performance, and some owners are no longer in touch with the original creator. A site assessment of these websites is beneficial in order to develop new goals and possibly refocus the website’s purpose.
The Website Health Check evaluates:
On location, three tests will be conducted. They will highlight both positive aspects and issues that may arise, giving you a comprehensive overview of your site – a full check-up.
In a small number of situations, some tests may not be performed for technical reasons. In such cases, an update and/or alternative report will be provided.
The Website Health Check costs Rs 2000.00.
